These Terms and Conditions (“Terms”) govern your use of our website, services, custom gift basket ordering process, and any purchases made through Thoughtful By Design (“Company,” “we,” “our,” or “us”). By using our website or placing an order, you agree to these Terms.

2. Custom Orders

Thoughtful By Design specializes in curated and customized gift baskets and gifting services.

Because many products are custom-designed based on customer preferences:

  • Product photos are examples and may vary slightly from the final delivered product.

  • Substitutions may occasionally be necessary due to product availability.

  • We reserve the right to replace unavailable items with similar items of equal or greater value.

  • Colors, packaging, ribbons, and decorative elements may vary.

We strive to maintain the overall style, theme, and value of each arrangement.

3. Pricing and Payments

All prices are listed in U.S. Dollars (USD).

Prices are subject to change without notice.

For custom gift basket orders, a non-refundable deposit equal to 50% of the total order price is required before work begins. The remaining balance is due upon delivery or prior to shipment.

Orders are not considered confirmed until the required deposit has been received unless otherwise agreed in writing.

Because our products are custom-designed and personalized for each customer, deposits become non-refundable once we have begun purchasing materials, assembling, designing, or otherwise preparing the order.

We reserve the right to refuse or cancel any order for reasons including but not limited to:

  • Product availability

  • Errors in pricing or descriptions

  • Suspected fraud or unauthorized transactions

  • Inappropriate or abusive customer behavior

If Thoughtful By Design cancels an order before work has begun, any deposit or payment received will be refunded in full.

If Thoughtful By Design cancels an order after work has begun, any refund will be determined at our sole discretion based on materials purchased, labor performed, and costs incurred.

4. Personalized and Custom Content

Customers are responsible for ensuring that any submitted personalization details, messages, names, dates, or custom requests are accurate.

Thoughtful By Design is not responsible for:

  • Customer spelling or grammar errors

  • Incorrect shipping addresses submitted by the customer

  • Delays caused by incomplete order information

By submitting custom content, you confirm that you have the right to use any names, messages, or materials provided.

5. Shipping and Delivery

Delivery timelines are estimates and are not guaranteed.

We are not responsible for delays caused by:

  • Shipping carriers

  • Weather

  • Natural disasters

  • Incorrect addresses

  • Events outside our control

Customers are responsible for providing accurate delivery information.

If a package is returned due to an incorrect address, additional shipping fees may apply.

Local delivery availability may vary based on location.

6. Refunds and Returns

Due to the customized nature of our products, all sales are generally final.

The 50% deposit required to begin a custom order is non-refundable once Thoughtful By Design has begun purchasing materials, designing, assembling, or otherwise preparing the order.

If a customer cancels an order before work has begun, any deposit paid may be refunded at our discretion.

If there is an issue with your order, please contact us within 48 hours of delivery at ThoughtfulByDesignCo@gmail.com.

Due to product availability, individual items may be substituted with similar items of equal or greater value. Such substitutions do not qualify for refunds, provided the overall theme, quality, and value of the gift are maintained.

We may offer a replacement, store credit, partial refund, or full refund at our sole discretion for:

  • Damaged Items

  • Incorrect orders

  • Significant quality concerns

We may request photographs or additional information to evaluate any claim.

Thoughtful By Design is not responsible for issues resulting from incorrect information provided by the customer, including recipient names, gift message, or delivery addresses.

7. Food and Allergy Disclaimer

Some gift baskets may contain food, beverages, candies, snacks, or other consumable products.

Customers are responsible for reviewing product ingredients and ensuring recipients are aware of potential allergens.

Thoughtful By Design is not responsible for allergic reactions, dietary issues, or misuse of products.

8. Intellectual Property

All website content, logos, branding, photos, graphics, text, and designs are the property of Thoughtful By Design unless otherwise stated.

You may not copy, reproduce, distribute, or use our content without prior written permission.

9. Limitation of Liability

To the maximum extent permitted by law, Thoughtful By Design shall not be liable for:

  • Indirect or consequential damages

  • Loss of profits or business

  • Delivery delays

  • Product misuse

  • Third-party shipping issues

Our total liability related to any order shall not exceed the amount paid for that order.
